| 摘 要： | 警察出庭作证是刑事诉讼改革中的重要问题。构建适合我国国情的警察出庭作证制度,首先应明确其理论依据,了解两大法系国家的有关制度及实践,继而找出阻碍该制度在我国确立的因素,最后分别从确立警察的证人资格、作证范围、构建启动程序及制约机制等方面着手改革。

| Abstract: | Police's appearance in court as a witness is an important problem in the reform of the criminal litigation.First of all,the theoretical basis should be determined to set up China's police appearance system.The relative systems and practical application of two legal countries should be studied and restrictive factors should be found.The reform can begin from these aspects: the police's qualification as a witness,the range of police's appearance,construct procedure and restrictive system. |
