论言词证据的审查判断

在侦查实践中 ,言词证据因具有生动形象、具体、获取效率高、办案成本低等优点 ,深受侦查人员重视。然而 ,由于受各种主客观因素影响 ,言词证据也存在虚假或失真等不足。因此 ,在侦查过程中 ,需要对通过各种途径收集到的刑事被害人陈述、犯罪嫌疑人供述、证人证言、鉴定结论等言词证据依据证据的客观性、关联性、合法性标准进行审查判断 ,确定其真伪 ,以保证办案质量

On Examining and Judging of Evidence of the Words

Influenced by various kinds of subjective and objective factors in investigating practice, the problems such as being false or distorted that the evidence of the words exists are in the course of it, although it is very necessary to examine and judge the evidence. Then it needs collect such evidences as criminal injured party's stating, suspect's stating, witness' testimony, expert's conclusion etc. through various kinds of ways. In order to confirm it is true or false, guarantee the quality of handling cases, the evidence should be examined and judged according to the standard of objectivity, relation and legitimacy of the evidence.
