| 摘 要： | 在生态文明建设的时代契机下,以外部性理论为探究视角,通过对农业生态问题的负外部性解读和农业生态保护的正升部性探讨,明确农业生态保护的必要性,进而提出我国农业生态保护法律制度架构的基本原则以及国家责任制度、规划和影响评价制度、综合利用制度、专家监督制度、利益分享制度和纠纷解决制度等具体法律制度,对加强我国农业生态环境保护,确保农产品质量与安全,提升农产品竞争力,保障我国经济社会和谐持续发展具有重要意义.
