语言权的限制与保护--从地方方言译制片被禁说起

国家广电总局发出<关于加强译制境外广播电视节目播出管理的通知>,禁止播放方言版的译制片.本文从宪法总纲中推广普通话条款的内涵谈起,对通用语言文字法以及广播电视管理条例的相关条款进行规范化分析,认为禁令限制过多,在相当程度上缺乏保护作为语言权类型之一的方言的意识,因为方言正如自然资源,具有稀缺性和不可再生性;方言是一定区域的人们在长期的生产实践中创造并不断丰富发展延续下来的语言,具有很强的地域性,是人们身份认同的一个重要标志;方言与当地历史文化血脉相连,是人们记录传承文明的重要工具.

Limitation and protection of language right--From the prohibition of translated movie in local dialect

According to the circular about tightening the supervision of broadcasting the dubbed foreign programs on TV and Radio issued by the State Administration of Radio Film and Television,the versions of foreign programs dubbed with Chinese dialects are not allowed to broadcast any more.Starting from dissecting the connotation of one clause of Chinese Constitution which promotes the use of the common language,the discourse analyzes the relevant clauses of the Law on Popular Language and Character and the Act on Supervision of Radio and Television.Then a conclusion can be made that such a ban imposed is inappropriately heavy and dialects receives no due protection as the common language.Undervalued by the rule-makers,Chinese dialects don't enjoy the language rights they deserve.Such practice is least expected because dialects should be treasured as natural resources for their scarcity and inability to reproduce.As languages that have been produced and developed constantly by local people through long-time practicing,dialects serve as an essential mark of identity.It's also reflected that dialects have a blood relation to local history and culture and play an important role in recording and passing on civilizations.
