行政公开及我国相关制度之完善

行政公开是民主政治的基本要求 ,是依法行政的价值取向 ,行政公开制度的确立和完善是我国推行依法治国政策的必然发展趋势 ,有其必要性及现实意义。我国行政公开制度的现状不容乐观 ,仍存在着一定的问题。建立与完善我国的行政公开制度可以从以下几方面着手 :1.在宪法中规定公民的知情权 ;2 .加强行政公开的法制化建设 ;3.扩大行政公开的范围 ;4 .规定违反行政公开的法律责任并建立相应的救济制度 ;5 .把行政公开与公民的言论自由结合起来 ,通过舆论监督促进行政公开

The Perfecton of Administrative Openness and Relevant Systems of Our Country

Administrative openness is the fundamental requirement of democratic politics as well as the value orientation of administering according to law. The establishment and perfection of administrative openness system is a natural developmental trend of the state policy of implementing rule by law and is also of necessity and practical significance. However, the status quo of our administrative openness system allows no optimism and certain problems still exist. To establish and perfect the administrative openness system of our country, we should undertake the following aspects:1.stipulating the right of civilian right to know in our constitution; 2.enhancing the legalization construction of administrative openness;3.expanding the scope of administrative openness;4.laying down the legal liabilities of the breach of administrative openness and establishing corresponding remedy system;5.and combining administrative openness with civilan freedom of speech and promoting administrative openness via public opinion surveillance.
