| 摘 要： | 保险诈骗罪是我国修订后的刑法所规定的一种新罪,学者们一般承认本罪存在犯罪的未遂形态,但是,对本罪的着手认定存在"开始实施法定行为说","虚假信息传递说","索赔说"三种观点。在比较分析的基础上,"索赔说"的观点应当更有利于司法认定,即应当以行为人开始向保险人申请给付保险金时为着手。

| Abstract: | The Crime of Insurance Fraud is a kind of new accusation of our revised Penal Code. The scholars generally admit that this crime exists its uncompleted forms, but as to the criterion of the crime's commencement. There are three kinds of standpoints such as "beginning to commit the legal behaviors", "delivering the deceitful information","claiming for compensation". The writer basically agrees with the last standpoints, namely the crime's commencement should begin with the person beginning to claim for compensation from the insurance company. |
