治安处罚裁量权的扩张与控制

《治安管理处罚法》的颁布,在一定程度上扩张了公安机关治安处罚裁量权的范围、方式与程度,从而也引发了关于这种扩张是否具有合理性,是否能够有效保护公民权益,以及如何对其进行控制与监督等诸多问题的思考。有必要通过对治安管理处罚制度中行政裁量权价值的理性考量,在对比新旧法律规定的基础上,进一步分析这种扩张的合理性与必要性。同时有必要建立一种立法、行政和司法三位一体的监督控制体系来防止裁量权的滥用,督促这种权力始终运行在维护公民权益的最终价值轨道上。

On Extention and Limitation for Right of Discretion in Public Order and Security Punishments

The newly-issued "Law of Punishments in Public Order and Security Administration" has increased the scope,patterns and degree of right of discretion for public security organs to implement punishments to some extent,which has evoked some consideration over such problems as whether it is reasonable or not,whether it is able to protect civil rights effectively or not and how to limit and supervise it.This article further analyzes the reasonability and necessity of power extention based on comparison between the new one with the old through a rational consideration over the value of administrative discretion in system of public order and security punishments.Meanwhile,it points out that it is necessary to set up a three-in-one-"legislation,administration and judicature"-system of supervision and control to prevent the abuse of right of discretion so as to urge it to be operated around a proper orbit to maintain civil rights.
