The Difficult Issues of Marxist Jurisprudence at Present in China

Change and openness are the prerequisites for developing Marxism. The theoretical origin of Marxist jurisprudence is scientific socialism. In contemporary China, Marxist jurisprudence is being challenged to certain extent. The Chinese development of Marxist jurisprudence is confronted with ten difficult issues. They are: the concept and nature of Marxist jurisprudence, the limitations of law function, the jurisprudential research method, the subject and object of law, the basic issue and concept of jurisprudence, the relationship between law and science and technology, the re- evaluation of western jurisprudential theories, the integration of Chinese transitional law culture, the review and evaluation of the century- long developmental history of Marxist jurisprudence in China, and the relationship between international and domestic laws as well as transformation of international law to domestic law.
