试论反垄断法执行机构的设置

笔者认为,我国反垄断法执行机构的设置应该考虑到两个方面的问题。一是要借鉴世界各国特别是西方发达国家设置反垄断法执行机构的经验教训;二是反垄断法执行机构的设置要结合我国的基本国情,即:国家设立专门的垄断委员会或竞争委员会,独立行使执行反垄断法的职权,行政序列上直接隶属于国务院总理,不受其他机关或个人的任何干涉

On Setting up Executive Agencies of Antimonopoly Law

To set up executive agencies of antimonopoly law, two sides have to take into consideration. One is to learn from experience of developed countries; the other is to connect with the situation of China. The detailed measures are as followed: Specific monopoly committee or competition committee is expected to be set up to exercise the functions. The committee directly under the jurisdiction of State Council Premier cannot be interfered by other agencies or individuals.
