论条约解释对国际法体系的维护——以VCLT第31.3条(c)项为例

对于国际法是否具有体系性、国际法分支学科是否具有自足性、国际法是否存在法律位阶,以及VCLT第31.3条(c)项的含义及其在维护国际法体系方面的作用等问题,学界仍无共识。尽管国际法体系仍然存在"碎片化"、相对的自足性特征,但基于共同的价值、发展中的国际法位阶体系、VCLT第31.3条(c)项对国际法体系的整合,国际法具有演变中的体系性。"碎片化"侵蚀了但不能否定国际法的体系性。国际法体系性受到侵蚀的原因较为复杂。国际法体系现状决定于国际社会权力结构的现实。VCLT第31.3条(c)项具有整合功能和发展功能,从条约解释角度维护了国际法的体系性。

On the Preservation of International Law System in Treaty Interpretation： From the Perspective of Article 31.3 （c） of VCLT

There is no consensus as to the following issues in academic circles： whether the international law system and its hierarchy and self-contentedness exist, the meaning of Article 31. 3 （ c）, and what role in Article 31. 3 （c） plays enhancing the international law system and so on. Although ＂fragmentation＂ and relative ＂self-contentedness＂ still exist in the international law system, the international law has an evolving system on the basis of the common value, the developing hierarchy and the integration of the international law system through Article 3. 3 （c） of VCLT. ＂Fragmentation＂ erodes but cannot deny the system of international law. The causes of the erosion of the international law system are complicated. The present situation depends on the reality of the power structure of international community. Article 31.3 （c） has the function of integration and development of international law, which preserves the system of international law from the perspective of treaty interpretation.
