权利用尽原则的国际适用与发展

知识产权是一个存在多元可能性利益的分配方案的权利,其中任何方案的实现都需要法律的支持和调和,该权利的可复制性导致了分配利益的复杂性。在国际上对知识产权的保护体现了其背后国家间利益的博弈,而目前国际上尚未对权利用尽适用的范围达成一致,因而导致各国可以依据自己国内的立法以及管辖权分别制定了相关的规定,这就造成了在国际上的多方争议以及适用上的混乱。知识产权权利用尽原则的制定就是为了阻止知识产权人利用知识产权的垄断性分割市场或者制定市场政策,因此权利用尽的发展必须符合保护权利和自由贸易的需求,保证市场的统一和和谐发展。

The Intellectual Property Application and Development in Worldwide of Exhaustion Doctrine

Intellectual property is a private right with the possibility of the benefits distribution,in which every aspect need the support and harmonization of law,and that result in the complication of distribution.The protection about this right in the universe shows the competition among them,especially the exhaustion of intellectual property.At the present time,there has no consistent on the principle.Therefore,the countries could take those matters in there own hands.As one of the important principles,the development of the exhaustion of intellectual property should consistent with protection of rights and free trade needs.
