| 摘 要： | 传统的财产保险代位求偿权不能适应保险行业的发展,人身保险代位求偿权在国内外立法例和学者争论中找到了适用的空间。本文从损失补偿原则的角度进行研究人身保险适用代位求偿权的正当性。在人身保险三大合同中,人寿保险不适用代位求偿权,健康保险和意外伤害保险根据具体情况部分适用。

| Abstract: | With the development of insurance, the right of insurance subrogation is inadaptable.The life insurance subrogation is produced with the legislation and argument at home and abroad.This thesis studies the proper application of subrogation right in life insurance.In the three contracts,the life insurance is not applicable.However,the healthy insurance and accident insurance are both partial applicable. |
