论我国累犯制度的不足与完善——一起猥亵儿童案引发的思考

司法实践中刑事案件累犯率居高不下,且三犯、四犯型的累犯、严重暴力性犯罪的累犯不在少数,累犯从重处罚的原则已经无法达到惩治累犯的目的。对于累犯这一特定人群,在刑罚上既要根据其主观恶性和社会危害性予以从重或加重处罚,维护社会的正义;同时对于这一群体中的部分个体,需"对症下药"地施以相应的保安处分措施予以治疗、教育、感化,以促使其改过自新,不再危害社会,体现刑法的人文关怀。再大而化之到整个社会层面,对于刑满释放人员也应加强引导,关注这一群体的民生问题,避免歧视,这对减少累犯也至关重要。
