| 摘 要： | 登记是海域使用权变动中的公示方法，其公示的是海域使用权的权属状况或者海域使用权的不复存在。“海域使用权公示”和“海域使用权享有”是两个完全不同的概念。只有基于法律行为导致的海域使用权变动，登记公示是海域使用权享有的要件。但海域使用权公示的效力还有登记对抗、未登记不得再处分两种。海域使用权登记制度中应该增加异议登记和预告登记两项制度。

| Abstract: | Registration is the notice method of the creation, alteration, alienation or termination of the oceanic area usufruct. Its content is to show the status of oceanic area usufruct or its termination. ＂The notice of the usufruct of oceanic area＂ is different from the ＂holding of usufruct of oceanic area＂ in connotation. Registration and notice are the essential elements of holding the usufruct of oceanic area only when the creation, alteration, alienation and termination of the usufruct of oceanic area are given rise to jurist act. Apart from the effects of notice, there are two other effects of registration and the system of registration of usufruct of oceanic area shall include the two kinds of registrations. |
