| 摘 要： | 目前.我国不宜彻底废除死刑,但对经济犯罪的死刑适用应区别对待.在我国对经济犯罪所设置的死刑罪名中.除五种犯罪适用死刑具有正当性外.大多数经济犯罪都不适用死刑.理由是经济犯罪适用死刑不符合罪责刑相适应原则;不能有效地遏制经济犯罪;死刑刺激部分经济犯罪嫌疑人携款外逃.使国有资产流失.建议调整经济犯罪的刑罚体系,改革自由刑,增设资格刑,加重财产刑.

| Abstract: | Currently,China should not thoroughly abolish death penalty,but as for those economic crimes which apply to the death penalty,most economic crimes are not suitable to apply to the death penalty,except five kinds of crimes.The reason is that economic crimes apply to death penalty,which does not agree to the principle of offences matching penalty,and can not suppress economic crimes.The death penalty stimulates some economic crime suspects escape abroad with huge sum of money,which lead to the loss of state p... |
