| 摘 要： | 黑格尔强调王权作最后决断的主观性 ,王权是其设计的政治制度的主要环节 ,实际上肯定了“王权就是任性”。但是 ,统观《法哲学原理》 ,可以看出 ,黑格尔明确指出 ,主观任性并不具有真理性 ,不能解决犯罪及其处罚等法律问题。黑格尔反对和否定主观任性 ,具有十分深刻的法哲学意义

| Abstract: | Hegel emphasizes the subjectivity of the power of king for making a final decision.The power of king is the key link for the political system that he designs and he actually affirms that"the power of king is a caprice".But,if we comprehensively study" Principle of Law Philosophy",we can see that,Hegel point out clearly and definitely that there no truth and solution for crime and punishment in subjective caprice.Hegel opposes and negates subjective caprice and that is quite incisive in law philosophy. |
