创新社会治理下的辅警法制化问题研究

十八届三中全会提出创新社会治理,在社会治理各项事务中辅助警察发挥了非常重要的作用。建设辅警队伍体现创新社会治理的深刻内涵,建设辅警队伍是创新社会治理的有效形式。但是当前辅警队伍存在法律地位缺失、公权私用乱象频发、统一的招录制度缺失、教育管理制度缺失、待遇晋升制度匮乏的现实问题,需要通过明确法律地位、确定法律职责和法制化准入机制、教育管理、待遇发展,实现创新社会治理背景下的辅警法制化制度建设,构建和谐警民关系。

A Study of the Legalization of the Auxiliary Police Against the Background of the Social Governance Innovation

The Third Plenary Session of the 18th Central Committee of the Communist Party put for- ward the innovation of social governance. The auxiliary police play a very important role in social affairs. The construction of the auxiliary police force, an effective form of innovation of social governance, testi- fies the connotation of the innovation of social governance. But currently, there exist some problems in the construction of the auxiliary police team, such as the auxiliary police＇s being lack of legal status, the abuse of public rights for private purpose, lack of the unified recruiting system, of educational manage- ment system and promotion system. It is necessary to make clear the legal status of the auxiliary police, to make definite the legal responsibility and legal recruiting system, to improve educational management and the treatment in order to develop the legal system construction of the auxiliary police against the background of innovation of social governance, and establish a harmonious relationship between the po- lice and the public.
