完善我国无效婚姻制度的思考

修改后的婚姻法中首次规定了无效婚姻制度,并通过其后的两次司法解释加以补充完善,这无疑是我国在婚姻立法方面的一大进步。但我国的无效婚姻制度的规定,仍然存在着许多的缺陷与不足。加强对婚姻家庭法制的研究,从以下几方面进一步完善婚姻法：对现有无效婚姻的范围作出进一步的的界定;适当扩大可撤销婚姻的范围;建立健全无效婚姻的法律救济制度;完善确认无效婚姻效力的程序。

Thinking on Perfecting China' s Invalid Marriage System

In China＇ s modified Marriage Law it isthe first time to stipulate China＇ s invalid marriage system and supplement and perfect it through the later two judicial interpretations. Beyond doubts itis a great progress in China＇ s marriage legislation. There still exist many defects in the stipulation of invalid marriage system like to strengthen the research on marriage and family legal system and perfect Marriage Law further; to define the range of current invalid marriage and properly expand the range of revocable marriage; to set and perfect the legal remedy system of China＇ s invalid marriage; and to perfect the procedure of ensuring invalid marriage validity.
