询问证人中的不当方法及其防治

在侦查活动中,询问证人的不当方法主要有:用语不当妨碍证人陈述、侦查人员态度不妥及缺乏做好证人思想教育工作的方法、询问时间和地点的选择不当、无节制地反复询问、采取多人集中询问、使用违法违规方法获取证言等。我们必须相应地采取措施,才能有效避免询问证人中出现的不当方法。

Incorrect Methods and Its Prevention in Inquiring Witness

In detection,inquiring witness mainly has the following incorrect methods:incorrect terminology hindering witness to state,improper detective's manners,lack of good method to do witness' ideological education work,improper inquiring time and place,intemperately repeatedly inquiring,adopting the multi-people concentrating inquiry,gaining the testimony with illegal methods and so on.We must take the corresponding measures to avoid the incorrect methods in inquiring witness.
