论我国著作人身权制度的完善

世界上第一部著作权法并不保护著作人身权,英美法系和大陆法系国家的早期著作权立法中均没有规定著作人身权制度,但是著作人身权目前已成为许多国家著作权法和知识产权国际公约中普遍承认的一种权利。著作人身权制度与民法人身权理论之间存在着矛盾。我国著作人身权制度设置的具体缺陷,主要有我国《著作权法》对著作人身权与其主体能否分离的规定自相矛盾,对著作人身权的种类设计不合理,表述著作人身权的权能内容不准确、内容限制不到位。对我国著作人身权制度应从立法上进行完善,包括规范著作人身权与其主体能否分离的规定,避免条文之间的自相矛盾,不设置独立的＂发表权＂,不将发表权列为著作人身权的范畴,署名权应是姓名权的延伸,署名权应是表明作者＂资格＂的权利,删除＂修改权＂,保留＂保护作品完整权＂,准确表述我国《著作权法》著作人身权的权能内容,并对内容进行必要的限制。

On the Perfection of the System of Moral Rights of Authors

The first copyright law in the world didn＇ t protect the moral rights of authors, which was not accepted in the early copyright law of both common law system and civil law system. Now, the moral rights of authors has been universally accepted in copyright laws of many countries and intellectual property in international treaties. Some contradictions exist between the system of moral rights of authors and the civil law personal rights theory. The main defects in our copyright law are explain problem on whether the moral rights of authors can be separated ed as follows. Self-contradictions exist in the with the ＇ authors＇. Many defects exist in the specific rights and limitations to the rights. To perfect the protection system of moral rights of authors, we should specify whether the moral rights of authors can be separated with the authors, right of disclosure shouldn＇ t be independently set up and put in the category of moral right, right of authorship should be the ex- tention of right of name which function is to indicate the right ＇ author＇ , the right of alternation should be dele- ted and the right of integrity should be kept. We should also specify the content of personal rights and make necessary limitations.
