我国普通未注册商标与注册商标冲突之处理

关于普通未注册商标与注册商标之间冲突的处理,《反不正当竞争法》第6条与《商标法》第59条第3款的规定存在着潜在的冲突。必须从普通未注册商标保护的中国语境和维护注册取得商标权体制的价值取向出发,结合在后注册商标是否存在不正当抢注、注册时间等因素,综合考虑诚实信用、保护在先权利、制止市场混淆等原则合理解释《反不正当竞争法》第6条与《商标法》第59条第3款,公平处理冲突。"N"标志不正当竞争纠纷案仅依据保护在先权利和制止市场混淆原则来处理普通未注册商标与注册商标之间的冲突略显机械。对此种冲突,不应非此即彼地处理,而应该尊重已经形成的市场格局,相互注意与对方作出区分。

On the Settlement of Rights Conflict Between Common Unregistered Trademark and Registered Trademark in China

In settling the rights conflict between common unregistered trademark and registered trademark,article 6 of the Anti-Unfair Competition Law potentially conflicts to para 3,article 59 of the Trademark Law.To fairly settle the conflict,the paper suggests to first consider the Chinese context for protection of common unregistered trademark and the value orientation of maintaining trademark registration system,then think about factors such as trademark squatting by registered trademark and registration time,then give overall consideration to such principles as good faith,protection of prior rights,stopping market confusion,etc.,and then reasonably explain article 6 of the Anti-Unfair Competition Law and para 3,article 59 of the Trademark Law.The settlement of"N"logo unfair competition dispute seems a little bit rigid because it only relies on the principles of protection of prior rights and stopping market confusion to address the rights conflict between common unregistered trademark and registered trademark.In addressing this kind of conflict,the either/or thinking pattern should be avoided.It is advised to respect the already formed market pattern and encourage both parties to distinguish from each other.
