| 摘 要： | 该文客观分析了中国刑法典对量刑情节规定的主要瑕疵,提出了对量刑情节的立法完善建议,指出电脑量刑技术的弊端、提出改进方向,并对颁布量刑指南的必要性和前提条件作了分析,为中国刑法典的修订提供参考。

| Abstract: | Plot of penalty measurement is an important constituent part of criminal law of China and also a thorny issue in terms of criminal theoretical research and judiciary practice. This paper has analyzed the main flaw in the code of criminal law of China concerning the plot of penalty measurement and put forward suggestions on legilative improvement. Combining the judicial requirments and current technical reality, this paper points out the malpractice of computerized penalty measurement and analyzes the necessity and precondition to issue the Guidance of Penalty Measurement. |
