| 摘 要： | 不平等刑罚制度是中国古代法的一个根本特征。它在封建社会中长期存在并发挥着功能,支撑其运转的是人们思想观念上的认同和接受。通过对不平等刑法制度存续原因的分析,可以为树立现代新型法治观念提供借鉴。
