中央苏区法制建设研究综论

中央苏区在进行大规模的政权建设的同时,对法制建设也十分重视。虽然中央苏区并不存在系统地对法制进行专门性研究的机构,但从既有的立法、执法和司法实践中,可以发现中共早期的一些重要的法学观。中央苏区的制度文本和法制实践反映着当时中共高层对作为政权建设中重要一环的法制建设的初步想法和计划,中央苏区的法制理念与实践为此后陕甘宁边区政府和人民共和国的法制建设奠定了一定的基础。

A Summary of the Legal System Construction and Research in the Central Soviet Area

At the same time when conducting large-scale regime construction,the Central Soviet Area paid much attention to the construction of legal system.Though the Central Soviet Area had no institution dedicated into systematic study of legal system,some early important views of the Party on the science of law can be found in the legislative,enforcement and juridical practices of that period.The institutional texts and legal practice of the Central Soviet Area reflected the primary thinking and plan of the CPC high-level leaders on the construction of legal system,which was an important content of regime construction.The legal system idea and practice of the Central Soviet Area laid a considerable foundation for the legal system construction of the Government of the Shaanxi-Gansu-Ningxia Border Area and the People’s Republic of China.
