| 摘 要： | 共同犯罪的主观方面不仅只有故意一种,共同过失亦应纳入到共同犯罪之范畴。共同犯罪应表述为：二人以上共同故意犯罪和共同过失犯罪。其中共同过失犯罪是指二人以上由于共同怠于履行注意义务、监督责任而造成严重后果的犯罪。对于共同过失犯罪的犯罪人,应追究其共同的刑事责任。

| Abstract: | The subjective elements of joint offence include not only with intention.Criminal negligence should also be one of joint offence.Joint offence should be stated that it is the jointly intentional crime and jointly criminal negligence made by more than 2 persons.Jointly criminal negligence refers offence made by over 2 persons because of fulfilling attention obligation and supervision task inactively which caused serious ending.The offender of jointly criminal negligence must be called to account joint criminal liability. |
