| 摘 要： | 将补充责任运用到侵权责任的承担上是我国立法和司法解释的独创，对侵权补充责任的基本问题进行探讨是很有必要的，而侵权补充责任的性质就是基本问题之一。侵权补充责任在效力上与连带责任、不真正连带责任是不同的，所以侵权补充责任是一种独立的责任形态。

| Abstract: | It＇s an original creation in legislation and judicial interpretation that supplementary liability is applied to tort liability. So it＇s necessary that some basic questions of supplementary liability should be discussed, the nature of supplementary liability is one of them. Supplementary liability is so different with joint and several liability and ungenuine joint and several liability in effeet that it is a kind of independent liability pattern. |
