口供补强规则初探

口供补强证据是指证明案件事实的同时，增强或担保口供证明力，共同证明案件事实的证据。口供补强规则属于证据规则之一，其既能有效的防止偏重口供，又能弥补口供的证明力不足，排斥虚假的口供。口供补强规则有三个主要特征：对口供证明力的限制，而不是限制口供的证据能力；仅适用于口供，而不适用于其他证据形式；约束控诉方和审判方，而不涉及被告人。口供补强规则由口供补强证据的对象、范围和证明标准三方面构成。根据口供补强规则，被告人的口供不得成为有罪判决的唯一依据，必须经由其他证据对口供进行补强后，法官才能作出有罪判决。
