政府管理与信息公开之法理基础

政府管理要达到“善治”的标准就必须使政府的活动置于“阳光”之下,即政府应将行政信息公开,这是政府的一项义务。行政信息之所以要公开,因为它是实现公民基本人权的必然要求;公开行政信息更是正当程序的重要构成要素;也是WTO规则的重要体现;从宪政的角度讲,行政信息公开是人民主权的重要组成部分;现代法上的公众参与理论也论证了行政信息公开的必要性和正当性。
