人权保障视域下的我国死刑政策现状分析

随着世界人权运动的发展，人权成为当前人类文明强有力的推动者，也是各国废除死刑最重要的原因和思想基础。在现阶段，我国虽然还不具备废除死刑的条件，但为了尊重和保障人权，严格控制和合理减少死刑的立法与司法，已是刑罚向人道化方向发展的共识与大势。因此，我们有必要对我国传统死刑政策进行反思，真正把惩罚犯罪与保障人权并重的理念落到实处，树立现代死刑政策的科学理念，为我国死刑政策提供正确、理性的导向。
