行政程序价值研究

行政程序价值在理论上有工具说、本位说和二元说之争,按其属性可分为程序的内在价值和外在价值。程序的内在价值是指程序独立存在的价值,主要包括程序参与、尊重公民权利与尊严、程序理性、自由和效率等价值;程序的外在价值是程序实现实体法价值的价值,包括秩序和公正价值。程序的内在价值和外在价值既是矛盾又是统一的,对其进行客观的评价,努力实现相互间的平衡,对推进行政程序法治化,促进依法行政具有重要意义。

The research on the value of administrative formality

The value of the administrative formality includes utility-theory,standard-theory and duality-theory in terms of theory,but,by nature,it has both inner and outer values.Its inner value refers to its separate one,including formality participation,respect of rights and dignity of citizens,formality logos and freedom and efficiency;while,its outer value is to achieve the value of the entitative law in the formality,including order and just value.Its outer and inner values are contradictory and unitive,so they needs evaluating objectively to fully realize the balance between them,which is of great help for the advance of the law of administrative formality and the promotion of handling clerical work in conformity with legal provisions.
