试论正当防卫的主观意识

正当防卫制度是我国刑法的一项重要制度,在社会呼唤正义、倡导见义勇为的今天,正当防卫制度尤为社会公众所关注。主观条件是正当防卫的重要构成条件之一,正当防卫主观意识、变化了的防卫意识可以导致防卫过当。我们应采取措施培养公民形成正当防卫意识,从而达到使公民充分行使正当防卫权,有效、及时地打击各种违法犯罪行为的目的。

The Subjective Consciousness in Legitimate Self-defense

Legitimate Self-defense System is one of the most important systems in Chinese Criminal Law.Nowadays,because our society appeals justice and advocate never hesitating to do what is right,public should pay more attention to legitimate self-defense system.The subjective condition is one of the significant component in legitimate self-defense.This paper does research from analyzing the consciousness of Self-defense,and tries to make an inquiry into the subjective consciousness of legitimate self-defense,over-defending caused by converting self-defense consciousness,and how to cultivate legitimate self-defense.The aim of this paper is to arouse citizens attaching importance to cultivate the consciousness of legitimate self-defense.For this reason,citizens can exercise the self-defense rights adequately in order to fight all kinds of crimes effectively and promptly.
