摘    要:大量商业秘密侵权案件表明,人才流动已成为商业秘密流失的重要途径.另一方面,自主择业又是劳动者依法享有的权利.平衡商业秘密权利人、雇员以及社会公众等各方面的利益,对于促进企业发展以及人力资源的合理分配从而构建和谐社会显然具有重大意义.于2008年1月1日起施行的<中华人民共和国劳动合同法>中一个重要进展是对商业秘密保护中竞业禁止制度做出了较为明确的规定,在对我国当前关于商业秘密保护中竞业禁止问题的立法状态的理性分析的基础上,提出完善我国商业秘密保护中竞业禁止制度的新思考.

Abstract:Considerable commercial secrets infringement cases show that free flow of talent is a dominant tunnel for the outflow of business secrets.However,independent choice-of-job is a legal right for any laborer.Hence,it is significant to construct harmonious society by balancing benefits of related parties like commercial secrets oblige,employee and the public which can enhance development of businesses with proper distribution of human resources.An important progress in PRC Labor Contract Law,has been effective on January 1, 2008,is that protection of commercial secrets in prohibition of business strife is precisely regulated.Based on the analysis of present legislation situation in the issue of prohibition of business strife related to protection of business secrets,the author of this article presents a new vision on improving the prohibition of business strife in the field of industry confidentiality.
