| 摘 要： | 当前，我国罚款数额的确定具有较大的随意性。并且调整机制相对欠缺。德国、奥地利和美国等国在罚款数额的确定和调整机制方面的经验和做法，值得我们借鉴。积极探索完善罚款数额的确定及调整机制的途径，要从罚款数额的设定、规范自由裁量行为和建立因物价水平变动而调整罚款数额的机制等多方面着手。

| Abstract: | At present, the determination of the amount of fine has great randomness and the adjustment mechanism is not sound. We can learn from Germany, Austria and the United States in this respect . To improve the mechanism of determining and adjusting the amount of fine, we should select the appropriate way to set the amount of fine, regulate discretionary behavior and adjust the amount of fine with the changes in price levels. |
