刑事诉讼撤销案件立法的缺陷及完善

刑事诉讼撤销案件是侦查终结的一项重要程序,但目前与此有关的刑事诉讼法及司法解释中还存在诸多缺陷,应通过完善立法,详细规定刑事诉讼撤销案件的原因,加强对撤销案件的检察监督,赋予撤销案件当事人知情权和异议权,合理处置涉案财物,从而实现撤销案件制度的价值。

Legislative Deficiency in Case Withdrawing of Criminal Proceedings and Suggestions on the Re-amendment

Case withdrawing of criminal proceedings makes an important procedure in case investigation.However,there are still some deficiency in the related criminal procedural law and the judicial explanation.Therefore,the study in the paper proposes that the law has to be re-amended in the following ways:(1) to specify the reasons for withdrawing;(2) to strengthen the inspection and supervision over the cases revoked;(3) to endow the parties to the cases withdrawing with the right to know and the right to dissent;(...
