事实婚姻与重婚罪的重合适用问题辨析

文章从正义和秩序两个角度分析了事实婚姻制度与重婚罪制度的基本价值取向。事实婚姻制度的秩序诉求是要建立一种否认事实婚姻行为效力的婚姻登记制度,通过这一秩序诉求的达到,进而实现意思自由原则、公序良俗原则与诚实信用原则的正义诉求;重婚罪制度的秩序诉求是建立刑法保护的一夫一妻秩序,通过这一秩序诉求的达到,实现一夫一妻的伦理正义。从对两者的比较分析中推论出对事实重婚行为应当同时适用两种制度的结论。

On the applicable Problems of the Coincidence of Practical Marriage and Crime of Bigamy

This article analyzes the basic value direction of practical marriage system and the system of crime of bigamy from justice and order angles. The order claims of practical marriage system are the marital registration system which is set up to deny the behavioral effect of practical marriage. And through the achievement of this order claims, it can fulfill the justice claims of freedom of the will doctrine, public order and good morals doctrine and good faith doctrine. The order claims of crime of bigamy system are to set up monogamy order which is protected by criminal law. And through the achievement of the order claims, it can fulfill the ethical justice of monogamy. Through the comparative analysis of the two systems, we can reason that practical marriage is applicable to the two systems simultaneously.
