试论行政合同及其程序规范和控制——兼谈行政程序法典是否对其专章规定

行政合同是传统行政向现代行政转变的必然产物,也是公法和私法相互渗透的完美结合.行政程序和行政合同一样,都是现代行政的民主,法治,公开,参与精神的体现和要求.本文试看从行政程序对行政合同规制的角度对行政合同的主体、范围、程序规制的内容做了相应的论述,并对正在起草的行政程序法典是否要专章规定行政合同谈了自己的看法.

On the Administrative Contract and Its Procedural Regulation and Control --Incident Discussion on Whether It Should Be Specially Stipulated in the Administrative Law

Administrative contract is inevitable product of the transformation from traditional administration to modern administration.It is also the perfect combination of the public law and private law.Administrative procedure,just like administrative contract,embody the domestic, role of law,participatory spirit of the modern administration.In this article,the authors,from the angle of the administrative procedure,try to discuss the scope of the subject and categories for the administrative contract.In addition,the authors give their opinions on whether the administrative contract shouldbe stipulated in a special chapter of the administrative procedure law.
