家庭暴力的法律思考

本文从实施家庭暴力的主体、家庭暴力行为方式、及其反映出的社会本质分析了家庭暴力的特征;从婚姻构成、传统思想及心理因素等方面剖析了家庭暴力的成因;并从刑事立法、执法,加强思想道德教育、发挥社区功能等方面提出了预防和遏止家庭暴力的应对措施。

Research On the Problem of the Domestic Violence from the Viewpoint of Law

The article,on the one hand,analyzes some characteristics on the basis of the subject,ways of the do- mestic violence as well as the its social nature,and on the other hand,analyzes the causes resulting in the domestic vio- lence in viewpoint of marriage structure,ideological convention and psychological elements.The author in the end of the paper proposes some suggestions about how to prevent and control domestic violence through criminal legislation,prosecu- tion of the law,digging up the more positive functions of the residential communities as well as ideological and moral edu- cation.
