| 摘 要： | 精神病人的刑事责任问题在我国古代就已经存在,世界上其他国家也有关于该制度的规定。精神病人的刑事责任有别于非精神病人,该制度的设计有其独特的社会价值。实践中,精神病人刑事责任理论和实践操作存在着一定的冲突,这种冲突需要从制度、工具和文化三个层面解决。

| Abstract: | Criminal liability of mental patients has been existing since ancient China as well as in other countries. The criminal liability of mental patients is different from that of common patients and its design has its own unique social value. In practice, there exist conflicts between criminal theory and practice, which shall be re- solved from the three aspects, that is, system, tool and culture. |
