社区矫正概念的多维思考与选择

对于社区矫正的概念,学界存在着不同的观点和看法,归纳起来主要有行刑说、救助监督说、处遇说、混合说、教育说等。这些概念,均或多或少地影响着我国的社区矫正试点工作。社区矫正有狭义和广义之分,我国的社区矫正应是广义的社区矫正,是指将符合社区矫正条件的人员置于社区矫正机构内,由专门的国家机关,在相关社会团体和民间组织以及社会志愿者的协助下,在判决、裁定或决定的期限内,矫正其犯罪心理和行为恶习,并促进其再社会化的活动。在这里,社区矫正是一个“社区制裁”的性质,而不是单纯的“社区刑罚”,它只对其中一部分矫正对象(罪犯)具有社区刑罚性质。社区矫正是一项独立的工作手段。其工作内容是对矫正对象的执行刑罚、监督管理、矫正教育、危机干预、社会救助等。

Multidimensional Ponder and Choice of the Community Correction Concept

For the concept of the community correction,the learners circle has different viewpoints,mainly including the execution studies,the rescue surveillance studies,place and meets studies,the mixture studies,the education studies and so on.These concepts,more or less affect community correction experiment work of our country.The community correction has the narrow sense and the generalized division,community correction of our country belong to the generalized one,it refers to that the personnel who are suitable to the community correction conditions are set to the organization,and their crime psychology and the behavior abuse get corrected by the special state agency,with the assistance of the correlation social group and the folk organization as well as the social volunteers,within the deadline of the legal sentence or decision,and finally promote their socialization once again.The community correction is "the punishment in community" in nature,but not pure "penalty in community ";it has the community penalty nature only to a part of criminals.The community correction is an independent work method.Its work content includes carrying out the penalty,inspecting and general management,correction and education,intervene the crisis,the social rescue and so on.
