论公安行政执法的公正性(上)

我国公安行政执法在实体、程序、理性等方面都存在诸多不公正问题 ,其原因既有法律法规内容的滞后、混乱和难以操作 ,有公安行政执法者执法观念、执法素质的不足 ,也有公安机关管理体制的落后和不良社会风气的影响等等。实现公安行政执法公正是一个复杂的系统工程 ,笔者对确保公安行政执法的公正提出若干建议 :改革行政管理体制 ,是确保执法公正的根本 ;完善行政法律法规 ,是确保执法公正的前提 ;强化民警综合素质 ,是确保执法公正的基础 ;规范行政执法活动 ,是确保执法公正的核心 ;改善执法监督机制 ,是确保执法公正的关键。

On the justice of administrative law enforcement (first part)

There still remain some injustice in the substance, procedure, and ration of administrative law enforcement in our country's public security. Our laws and regulations are confusing, difficult to be operated and unable to meet the current needs. The law enforcers of our public security are lack of senses and qualities needed in law enforcement. Management system of public security's organizations is backward and some social phenomena bear harmful effect .All these factors result in the situation. It is a complicated systematical project to realize the justice of public security's administrative law enforcement. Thus the author proposes some suggestions: Reforming the system is the root; perfecting the laws and regulations is the premise; enhancing police's qualities is the base; standardizing the activities in law enforcement is the center; improving its supervision system is the key.
