| 摘 要： | 当今学术界对无限防卫权的概念与特征存在不同认识,有人甚至建议取消这项新规定,这种争议其实都源于对无限防卫权的权利本位的认识模糊。刑法规定无限防卫权,从某种意义上讲,这是正当防卫权的一种特殊形式,两者之间具有一定的包容关系,无限防卫权除具有正当防卫权应有的基本特点外,还应该有自身所独有的特点。对无限防卫权的权利根基进行探究,并对其在我国刑法中规定的含义进行诠释,对正确理解无限防卫权具有重要意义。
