| 摘 要： | 非监禁刑作为一类刑事制裁方法,与监禁刑相比,在发挥刑罚的教育和矫正功能、体现刑罚人道性和谦抑性思想以及实现刑罚适用的经济性和效益性等方面具有无可比拟的优越性。我国以监禁刑为主的刑罚模式居于主导地位。我国应当积极倡导非监禁刑的广泛适用,弥补监禁刑适用的不足。

| Abstract: | Non-imprisonment,as a kind of criminal penalty,possesses incomparable superiority in penalty's education and correction function,expression of humanized penalty modesty ideology and the realization of the applicable penalty and efficiency of the economy.Imprisonment mainly for the penalty model occupies a leading position.China should advocate wide application of non-imprisonment. |
