Research on the Legal Method of Case Guidance System

The case guidance system has been basically established in China,but its application effect is not ideal,and there are still some problems such as the disconnection with the actual needs of judicial practice,the excessive methods of interpretation of meaning,and the inadequate legal argumentation.Therefore,we should pay attention to and improve the judge’s reasoning ability,coordinate the use of a variety of interpretation methods,weigh the advantages and disadvantages of all parties to gradually resolve the application problems of the case guidance system,so as to promote the early realization of the harmonious and unified judicial application situation.
