| 摘 要： | 危险犯的危险是指危害行为所造成的具体危险状态;危险犯概念的界定不应考虑其犯罪形态。我国刑法中的危险犯是指以行为人所实施的危害行为造成了具体的危险状态作为犯罪成立条件的犯罪。
