论法律确定性在解释中之实现

司法活动中,涉及具体案件法律适用的法官作为法律解释主体,其解释行为直接关系法律的确定性。法官解释行为并非纯主观或者任意的,相反,要在法律规范性的规制下,兼顾历史与现实。法律解释的这些特质,都没有脱离法官、当事人以及普通民众对于法律规范性的认同;而如若从客观上讲,这表达了整个社会对于司法的普遍态度。
