机动车交通事故责任强制保险若干问题研究

我国《机动车交通事故责任强制保险条例》已实施四年有余,但仍存在许多问题有待完善。文章针对它的保障范围规定的不足,提出了应对财产损失的赔偿进行限制的完善对策;为保障受害第三人能及时获得足额赔偿,应赋予其对保险人的直接请求权;针对社会救助基金存在的问题,提出完善社会救助基金的适用范围、拓展其资金来源、明确其管理机构等建议,以期进一步完善机动车交通事故责任强制保险制度。

Study on Some Problems of Compulsory Auto Liability Insurance

The Regulations on Compulsory Auto Liability Insurance has implemented for more than four years, but there are many shortcomings to be perfected. According to the shortcomings of compensation range, the property damage compensation should be restricted. In order to ensure the third party be compensated sufficiently in time, the third party should be given direct petition - right. This paper finally advances some suggestions to solve the problems of relief fund, such as perfecting the application scope of relief fund, expanding the sources of fund, and clearing the administrative organization, aiming at further perfecting the compulsory auto liability insurance system.
