我国服务侵权责任法律之不足与完善

在我国质量侵权责任法律体系中,相对于产品侵权责任法和建筑侵权责任法而言,服务侵权责任法相对滞后,在相当一部分领域,法律处于空白状态。为促进我国服务贸易的发展,完善服务侵权责任法,应制定服务行业质量的基本法及相应的行业性法律;应修改、补充、完善现行服务行业法律规范,增强法律的可操作性;应考虑国际社会通行作法,结合我国实际,使我国服务行业法律规范尽可能与国际接轨。

Dravobacks and Perfection of the Law on Service Liability for Tort in China

Compared with the law on product liability for tort and the law on building liability for tort, the law on service liability for tort relatively falls behind in the system of the law on quality liability for tort. There is no law in many fields of service. In order to advance service and perfect the system of the law in this aspect, some basic laws should be established and perfected. Considering the situation in China and the normal rule in the world, cooperation with the world is a nelessity.
