论对法律的违宪审查

宪法的基本功能是通过控制、分配和保障国家权力的运行,以达到保障人权的基本目的。而控制国家权力的运行是完成宪法功能的基本方法和基本前提。在宪法所控制的国家权力之中,最主要的是立法权的行使,即作为立法权表现形式的法律。宪法对法律的控制,又可以分为事前控制和事后控制。作为事后控制的基本方法是对法律实施违宪审查。而在此领域,我国存在着认识上的误区和制度上的空白。

On the Constitutional Review of Law

The basic functions of constitution law are carried out through operations of the control, distribution and protection of state powers in order that human rights are safeguarded. However, the execution of the control of state powers is only the basic method and pre-condition for carrying out the functions of constitution law. And among the state powers, the constitution is carried out mainly through the control of legislative power, i.e. the law in the form of legislative power. The constitutional control of law is carried out in pre-and post- control. The basic post-control is the constitutional review of legal implementation, wherein there exists mistakes of understanding and gaps of institutions.
