关于传统无权代理理论的若干质疑与重构

关于无权代理理论,学界大多主张狭义无权代理不具代理权之表象,且本人有过失并非表见代理的构成要件。本文从理论与实践两个角度对此提出质疑,并对上述理论进行重构。最后,本文还对如何具体适用表见代理制度提出了相关的建议。

On the Challenge and Reconstruction of the Traditional Theory of Unauthorized Agency

With regard to the theory of unauthorized agency, most of scholars argue that unauthorized agency in narrow sense has no appearance of right of agency, and the fault of principal is not the essential elements of agency by estoppel. This article questions these argument from theoretical and realistic angle, and reconstructs above-mentioned theory. Finally, the author presents the relevant suggestions to apply to the system of agency by estoppel properly.
