| 摘 要： | 本文是关于非物质文化遗产权权利性质的探讨。在概括介绍国内外具有代表性的文化权利说、传统资源权说、知识产权说、土著产权扩张说等学说的基础上,重点论证了非物质文化遗产权与现有民事权利中最为近似的知识产权的差异,提出非物质文化遗产权应界定为一种新型的独立权利的主张。
